127) Chapter: Killing A Captive Without Inviting Him To Islam

Narrated Sa'id ibn Yarbu' al-Makhzumi:

The Prophet (ﷺ) said: on the day of the conquest of Mecca: There are four persons whom I shall not give protection in the sacred and non-sacred territory. He then named them. There were two singing girls of al-Maqis; one of them was killed and the other escaped and embraced Islam.

Abu Dawud said: I could not understand its chain of narrators from Ibn al-'Ala' as I liked.

127) باب قَتْلِ الأَسِيرِ وَلاَ يُعْرَضُ عَلَيْهِ الإِسْلاَمُ

حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، قَالَ حَدَّثَنَا زَيْدُ بْنُ حُبَابٍ، قَالَ أَخْبَرَنَا عَمْرُو بْنُ عُثْمَانَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَعِيدِ بْنِ يَرْبُوعٍ الْمَخْزُومِيُّ، قَالَ حَدَّثَنِي جَدِّي، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ يَوْمَ فَتْحِ مَكَّةَ ‏‏ ‏.‏ فَسَمَّاهُمْ ‏.‏ قَالَ وَقَيْنَتَيْنِ كَانَتَا لِمِقْيَسٍ فَقُتِلَتْ إِحْدَاهُمَا وَأُفْلِتَتِ الأُخْرَى فَأَسْلَمَتْ ‏.‏ قَالَ أَبُو دَاوُدَ لَمْ أَفْهَمْ إِسْنَادَهُ مِنِ ابْنِ الْعَلاَءِ كَمَا أُحِبُّ ‏.‏ "‏ أَرْبَعَةٌ لاَ أُؤْمِنُهُمْ فِي حِلٍّ وَلاَ حَرَمٍ ‏"
