44) Chapter: Regarding A Man Who Finds His Exact Property With Another Man

Narrated Samurah ibn Jundub:

The Prophet (ﷺ) said: If anyone finds his very property with a man, he is more entitled to it (than anyone else), and the buyer should pursue the one who sold it.

44) باب فِي الرَّجُلِ يَجِدُ عَيْنَ مَالِهِ عِنْدَ رَجُلٍ

حَدَّثَنَا عَمْرُو بْنُ عَوْنٍ، حَدَّثَنَا هُشَيْمٌ، عَنْ مُوسَى بْنِ السَّائِبِ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدُبٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏‏ ‏.‏ "‏ مَنْ وَجَدَ عَيْنَ مَالِهِ عِنْدَ رَجُلٍ فَهُوَ أَحَقُّ بِهِ وَيَتَّبِعُ الْبَيِّعُ مَنْ بَاعَهُ ‏"
